2. Where do I go for a 200' Radius Map?

Radius Maps will be provided by the Engineering Department as a courtesy to the homeowner, at a fee of $5.00 per Tax Map. If an Architect or Engineer is preparing the drawings then he or she will be responsible for drawing the Radius Map, but we will supply the Tax Map at $5.00 per page.

3. What is the difference between a local, county and state road?

West Orange Department of Public Works (973-325-4067), is responsible for services on municipal roads. County and state roads are serviced by their respective agencies. A list of county and state roads along with contact information for these agencies is provided below.

The COUNTY ROADS in West Orange are:
Central Avenue, Eagle Rock Avenue, Laurel Avenue, Main Street, Park Avenue,

1. What is the procedure for applying for a marriage / civil union license?

The license must be obtained from the municipality in which either party resides, if they live in New Jersey. If both parties live outside of New Jersey, the license must be obtained in the municipality in which the ceremony takes place. A license applied for and issued in New Jersey may never be used outside of New Jersey, and a license issued in another state may never be used in New Jersey.

2. How can I obtain a certified copy of a vital record such as a birth, marriage, or death certificate?

Call the Bureau of Vital Statistics 973-325-4120. If marriage, birth or death occurred in West Orange you can write to the Health Department with detailed information, requesting copy of the certificate. Also send $10.00 and a copy of your Picture ID (Driver License).

3. How can I obtain an application to license my dog or cat?

Dog and cat licenses are renewable annually and are due in January. New pets six months of age or older must be licensed at this time or when this age is reached during the year. On March 1st a $10.00 late fee will be charged for dog licenses and a $5.00 late feel will be charged for cat licenses. Application instructions are on the reverse side of the renewal form. If rabies vaccination information or spay/neutering status has changed during the year, please include the veterinarian certification so that pet records may be updated. All required documentation and the appropriate fee must be submitted with the renewal form or everything will be returned to you. A rabies vaccination must have an expiration date valid through November 1 of the year in order to purchase an animal license.

Social Services are provided via the Township Social Worker. Counseling and referral services are offered by the Social Worker to residents who may require intervention and management. New Jersey American Water Company is the water provider to the Township of West Orange. They can be reached at 1-800-652-6987. The Township DOES NOT provide water to residents.

11. When do I receive my property tax and sewer bills and when are these payments due?

Your property tax bill is mailed out once a year by July 1. Sometimes this is an estimated bill and a second bill will then be mailed to you by October 1. Property taxes are due February 1, May 1, August 1 and November 1 of each calendar year.

Your sewer bill is mailed to you in by March 1. The payment is due April 1.

1. When do I need a building permit?

Before you proceed with any construction or alterations, call or email the Building Department at (973)325-4112 or wobuilding@westorange.org.

Many factors determine what you will need. A permit is required to construct, enlarge, demolish, install or alter any structure such as commercial property and residential homes. Permits are also required for installation and replacement of equiptment such as air conditioning and furnaces. Permits are not required for minor work that is considered ordinary repair such as exterior and interior painting and roofing/siding that is LESS than 25%. Permits are also not required for direct replacement of windows that remain the same size; replacement of plumbing fixtures such as sinks and tubs in the same location.

2. Where do I get building permits?

Building permits are available at the Building Department office located at 66 Main Street, West Orange, Second Floor, Room 217. The forms are the standard UCC forms, you must submit the original carbon copy forms.

3. How many sets of drawings are required when submitting an application for building permits?

Two sets of drawings are required when plans are being submitted for review.

4. How much do building permits cost?

The cost depends on what work you are doing, and the estimated cost of work of the proposed construction job. Fee Schedule Building & Construction

5. Who is responsible for obtaining a permit?

The owner or his/her agent, a licensed engineer, architect, or plumbing, electrical or other contractor employed in connection with the proposed work can apply for a permit. If the application is by a person other than the owner in fee, it shall be accompanied by an affidavit of hte owner or the authorized person making the application, that the proposed work is authorized by the owner in fee, and that the applicant is authorized to make such application. All issued permits shall remain the property of the owner even if the application was made by a contractor or quthorized agent.

6. How long does it take to obtain a permit?

It depends on on what type of work is involved. State law requires that the Building Department review your application within twenty (20) working days of receipt. If the permit requires zoning approval, the Zoning Official has ten (10) working days for her/his approval prior to being reviewed by the building officials. Smaller projects may not require as much time. The summer is the busiest season, so please allot additional time.

7. What hours can construction work be performed?

On weekdays between 7:30 A.M. and 7:00 P.M.; Saturdays between 8:00 A.M. and 5:00 P.M., or between 8:00 A.M. and 7:00 P.M. when the work is being done by an occupant owner of the premises; Sundays between 9:00 A.M. and 5:00 P.M., or between 9:00 A.M. and 6:00 P.M. when the work is being done by an occupant owner of the premises.

8. I own a single family residence; can I do my own construction work?

Yes, if you are the owner occupant of a single family home you can be your own contractor. You will want to contact the building department to find out if any permits are required for the work you are doing and if so, you you can complete the permit as a homeowner, and (if needed) prepare your own plans. Plans for multiple family dwellings and commercial properties require an architect's seal.

9. What is considered minor work?

NJAC 5:23 - 2.17A (c)

1. Minor work shall mean and include the construction or total replacement of any porch or stoop which does not provide structural support for any roof or portion of a building; the construction or alteration of any rooms within an existing one or two-family dwelling, provided that no structural members are altered in any way; the removal and replacement of more that twenty-five percent (25%) of the exterior siding of a one or two-family dwelling;

2. Minor work shall also mean and include the replacement of any existing plumbing piping work with new and approved material of like capacity; the installation of drinking fountains and condensate drains in existing structures; the replacement of existing low-pressure hot water heaters with new ones of like capacity; and the new installation of lavatories, water closets, tubs, showers, washers or diswashers, and garbage disposers in existing space of one and two-family dwellings where the new installation of additional fixtures can be accommodated with no increase in the size of the water distribution system, water service or house drain;

3. Minor work shall also mean and include new electrical work incidental to the installation of air conditioning, equipment, clothes dryers, and ranges or ovens in one and two-family dwellings; the installation of five (5) or less 110 or 220 volt receptacles or fixtures where existing circuits and/or available space circuits and service are adequate to support the load; the replacement of existing wiring with new wiring of the same capacity provided that the new wiring shall be of a type approved for the use by the code;

4. Minor work shall also mean and include the installation of any fire detection or suppression device in any one or two-family dwelling; installation of a radon mitigation system in an existing detached one or two-family dwelling; the installation of a burglar alarm or security system in any structure and the installation of a low voltage communication system in any structure other than a one or two-family dwelling;

5. Minor work shall not include lead abatement;

6. Minor work on elevator devices shall also mean and include work as outlined below and not involving any structural alteration to a building and as scoped within the applicable sections of Part XII of ASME A17.1 referenced in the building sub-code.

10. When is a licensed contractor required?

A licensed plumbing, electrical or fire contractor is required for all work on commercial properties and multiple family dwellings. Homeowners fo single-family homes can conduct the work themselves if they are knowledgeable in the field of work to be performed.

11. If I need to dig on my property, what do I need to do?

If you need to dig on your property, New Jersey law requires you to provide at least three business days notice before beginning outdoor construction or digging.

Contractors,property owners, or whoever is excavating must call New Jersey One Call at (800) 272-1000 and take the following steps:

• Wait for the site to be marked with paint, flags, or stakes.
• Respect the marks and dig with care.
• Hand dig within two feet of buried piping and facilities.

12. When is a survey required for a building permit?

A survey of your property is required when submitting an application for the construction of an addition, deck, fence or new building.

13. Can I obtain a copy of my property survey from the Township?

No; you need to contact your mortgage company or attorney who did your property closing. You might also check your title insurance papers for an attached copy of your survey. The Building Department would only have a copy of your survey if you did work on the property in the past that required a copy of the document. There are no other Township or County departments that keep your survey on file.

14. Should I be concerned about an oil storage tank when I am purchasing a home?

Yes. In order to find out if there is/was an oil storage tank on the property you should complete an Open Public Records Act (OPRA) form in the Municipal Clerk's office in Town Hall. The Building Department cannot give property information to a person who does not own the property.

Once the OPRA request has been received by the Clerk's office, they will send it to our office; within seven (7) business days we will advise you if we have records available for your review. There is only a fee if you request printed copies of records. OPRA Request Form

15. What permit is required to fill or remove an oil storage tank?

To fill an oil storage tank, a mechanical and fire permit is required. Materials such as sand, gravel or foam can be used for filling such tanks. A mechnical permit is required for the removal of a residential or commercial oil storage tank. Mechanical & Fire Permit

16. When am I subject to a fine?

Monetary penalites may be imposed when work has commenced prior to the issuance of a building permit and failure to have all inspections conducted throughout the project.

17. Can a penalty be appealed?

If you wish to contest a penalty notice, you may request a hearing before the Essex County Construction Board of Appeals within fifteen (15) days of receipt of the penalty notice. The Fee for an Appeal is $100.00 and should be forwarded with your application to the Construction Board of Appeals Office at 900 Bloomfield Avenue, Verona, NJ 07044

Your application for appeal must be in writing setting forth your address and name, the address of the building or site in question, the permit number, the specific sections of the Regulations in question, and the extent and the nature of your reliance on them. You may include a brief statement setting forth your position and the nature of relief sought by you. You may also append any documents that you consider useful.

18. What is the minimum required depth of footings?

Footings have to be at least 42 inches (3'-6") from existing grade.

19. When are railings required for steps on a building?

Railings are required for steps when three (3) or more risers are being constructed.

20. What is the required space needed between balusters?

Less than four inch (4") spacing is the maximum dimension between balusters.

21. What is the required minimum ceiling height to finish a basement?

The height of the ceiling must be seven feet (7') or more from basement fllor to ceiling. (Link to Finished Basement Requirements.) Finished Basement Requirements

22. Is it legal to have a bedroom in my basement?

No. Sleeping in the basement is not permissible in any house. If the basement is below ground, a bedroom is not allowed. If the basement has a walk-out to the outside, then a bedroom is allowed. 23. What is required to install a swimming pool?

A building permit is required for the installation of your pool. Depending on what type of pool you are installing, various approvals may be required.

If you are installing an in-ground pool, an approval from the Engineering Department is required before you can secure a building permit. You need to submit two (2) copies of a grading plan to their office, located at 25 Lakeside Avenue, West Orange, for approval BEFORE submitting your permit application package to the Building Department.

You must also provide the Building Department with a copy of your property survey (marked to indicate the location of the pool), the specifications on the pool, filter and ladder. 24. Do I need a permit to replace my water heater?

Yes, a permit is required to replace your water heater or furnace/boiler. These appliances are probably the most dangerous equipment in your home.

25. Do I need a permit to demolish my garage?

Yes. You need a building permit to demolish a garage. Please be aware that there is an ordinance that a single family house must rebuild their garage once it has been demolished. Demolition Requirements

26. Can I make a living space out of my garage?

All single family houses are required to have space for one vehicle in their garage. If you plan on converting your garage into a living space, you will be required to go before the Zoning Board of Adjustment.

27. May I rent out a room in my single family house?

Yes, but you are required to obtain a Certificate of Occupany (CCO) prior to renting out the room. Please note there are codes that restrict the number of persons living in a house, for example there is a code limiting up to four (4) unrelated people living in a house. 28. What should I do if I think my neighbor is doing construction without proper permits?

29. How do I find out if my home property is in a flood zone?

To find out if your home property is part of the flood zone, you must contact the Construction Official at (973)325-4112 or email wobuilding@westorange.org for a review of Township Flood Maps.

30. How do I find the block and lot number of my house?

To find the block and lot number of your house, contact the Tax Assessor's office at (973)325-4060, or you can refer to your municipal tax bill that you receive in the mail quarterly.

31. Will my taxes go up if I build a deck?

32. Do I need a permit number when calling the Building Department for an inspection request?

Yes. To access your file, the Building Department database requires a permit number as well as address and nature of the inspection needed.

33. Do I need a permit to remove a tree from my property?

34. Do I need a drawing sealed by a New Jersey licensed architect?

Not always. Some small projects where you are doing the work as a single family homeowner occupant, such as a deck, can be drawn by yourself. However, the drawing must be detailed. Guidelines for Additions & Decks

36. How do I know if an inspector is qualified to inspect my work?

All Township inspectors are licensed by the State of New Jersey, Department of Community Affairs, Division of Codes and Standards, to inspect all phases of construction that require a permit.

37. Do I need a permit for a garage or yard sale?

Yes. The Township has a garage sale ordinance. The application is available online or in the Planning Department office, 66 Main Street, Room 217. The application must be signed by the property owner and submitted to our office at least one (1) day prior to the sale. The fee is $5.00. We will issue the permit and two signs (additional signs are available for a fee of $.50 each). When issued, the permit is valid for four (4) consecutive days. 38. Do I need a permit for a sign?

40. Does the Township have a Historic Society?

41. How close to my property line can I build an above-ground pool?

An above-ground pool is required to be at least 10 feet (10') from the side and rear property lines.

42. How close to my property line can I build an in-ground pool?

The water line of the pool is required to be at least seven feet (7') from the property line. The concrete walkway around the pool is required to be at least four feet (4') from the property line.

43. What do I need to do if I want to put up a fence?

You will need a permit to put a fence in your backyard or replace an existing fence. You must complete and submit a fence application to our office, Residential applications are $50.00; commercial applications are $100. 44. How can I find the zoning information for my property?

To find out your property's zoning information you must contact the Zoning Official at (973)325-4119 or email zoningofficial@westorange.org. You must provide the street address and Block and Lot number to determine the zoning of a particular property.

45. How close to my property line can I build a deck or addition?

The minimum distance required to the property line depends on the zone of your property. Contact the Zoning Official at (973)325-4119 or email zoningofficial@westorange.org.

46. Do I need a permit to install a shed on my property?

To install a shed that is less than 200 square feet, you are required to submit  a survey of your property to zoningofficial@westorange.org indicating the distance of the shed from your property line. If the square footage of the shed exceeds 200 feet, you will be required to obtain a construction permit in addition to submitting your property survey.

47. What is a Certificate of Continued Occupancy?

A Certificate of Continued Occupancy (CCO) is required when there is a change in tenant/occupancy of any residential property or commercial property for sale or re-rental. The fees for commercial properties are based on the square footage of the building; the residential fees are determined by the number of units being sold or rented. Before a CCO can be issued, the CCO Inspector and a Property Maintenance Inspector must conduct an inspection of the property.

48. Can I install a driveway on my front lawn or a curcular driveway in front of my house?

The Zoning Official must look at a copy of your property survery to determine if you meet the setback requirements. The Zoning Official may determine you need Planning Board or Zoning Board approval, because the driveway requires a variance. Additionally, you must contact the Township Engineer to determine the Engineering approval requirement as well as obtain a curb-cut permit. 49. What is the Planning Board and Zoning Board of Adjustment?

The primary responsibility of the Planning Board and Zoning Board of Adjustment is to hear and vote on requests for variances or exceptions to our Zoning Ordinance. For some applications, the Boards will review and approve or deny a site plan. Other powers of the Boards include hearing and deciding appeals of decisions made by an administrative officer such as the Zoning Official or Township Planner. The Boards also interpret the zoning map and zoning ordinance.

The Municipal Land Use Law (MLUL), 40:55D, sets forth statutory law guiding the Planning Board and the Zoning Board of Adjustment.

50. Where can I obtain a Planning or Zoning Board application?

You can obtain an application in the Planning Board and Zoning Board office located in the Township Municipal Building, 66 Main Street, Room 214. Office hours are 8:30 A.M. - 4:30 P.M. 2. Can I park on the street overnight in front of my home?

Parking is prohibited between 2 a.m. and 5 a.m. daily, except otherwise posted, on all township streets. In the event a resident occasionally needs to leave a car on the street during these hours, call the police desk non-emergency at 973-325-4000 and request permission to park. If a resident is having construction performed on the driveway or property and require longterm on-street parking permission, contact our Traffic Bureau during normal business hours at 973-325-4044 or 4045 for assistance.

1. How do I dispose of grass clippings?

Grass clippings should be placed in plastic bags and disposed of with the regular garbage. Please do not place grass in brown paper bags, as these bags will be perceived as recyclables and will not be picked up with the garbage.

2. What do I do with my leaves?

From October 22nd to December 14th, Public Works picks up curbside leaf piles on every street in the town with the exception of county roads. Leaves at curbside shall be placed according to the leaf schedule on the website. There are usually at least two loose leaf pickups per season, weather permitting. From October to the end of December and from March to the end of May leaves can be placed in biodegradable paper bags for pick up. During March thru May residents should contact Public Works to schedule a leaf bag pick up. Leaf bags can be purchased from the Engineering Department (25 Lakeside Avenue),the Purchasing Department (66 Main Street) or the Environmental Center (590 Mt. Pleasant Avenue) for .40 cents each bag (5/$2.00). These biodegradable bags are for leaves ONLY, bags containing materials other than leaves, such as grass, branches, dirt, or stones will not be accepted. Home owners residing on a county road should contact the Essex County Public Works to get a Fall Leaf Pick up Schedule.

3. What do I do with tree branches?

Residents are encouraged to bring vegetative waste to the Environmental Center located at 590 Mt. Pleasant Avenue. However, tree branches cut into three (3) foot lengths and bundled together are acceptable for the regular garbage pickup. If the branches have fallen off a town tree or the branch is blocking the street, please contact Public Works for removal.

4. How do I get my town tree trimmed or removed?

In general, town trees are located either on town property or within ten (10) feet of the curb line on town streets. If a tree needs to be trimmed or removed, contact us and our Shade Tree Supervisor will come out to assess the condition of the tree and determine what the tree needs. The town does NOT service trees on private property or along county and state roads except in emergency situations.

5. How do I get a pothole repaired?

For potholes on township streets, contact us. Someone from our road division will come out and assess whether it is a pothole or a sinking utility trench. We will either repair the pothole or inform the responsible agency if is not under our jurisdiction. Residents are encouraged to report any potholes immediately.

6. How do I get my street swept?

The street are swept either on a weekly or bi-weekly schedule. However, sometimes because of mechanical breakdowns or other events, including cold and snowy weather, the sweepers may not be able to adhere to their schedule. If your street has not been swept in several weeks, please contact us.

7. How do I get my street snow plowed?

During snow emergencies, the township plows the local township streets. Essex County plows the county roads and the State plows I-280 and Route 10. There are approximately 100 miles of township streets to plow,and we will service all the streets as soon as possible. In cases of medical, fire, police or other similar emergencies that require immediate attention, please call 911. It may be impossible to plow a street if it is blocked by parked vehicles or other barriers until they are removed.

8. What do I do if I have a problem with my sanitary sewer?

If you have a stoppage in your sewer connection, please contact us. The town is only responsible for the main sewer and will inspect it to make sure it is functioning properly. If there is no problem with the main line, then the problem is in your connection. The home owner must have their connection cleaned out or repaired by a plumber or sewer cleaning service.

9. What do I do if my recyclables are not collected?

If your recyclables were not picked up on the scheduled day please contact us t 973-325-4121 and we will inform Suburban Disposal.

10. What do I do if I have a problem with my water, electricity or gas?

Any water issues in your home (poor water pressure, water quality, no water) should be directed to New Jersey American Water Company at 1-800-652-6987.
Any electricity or gas issues in your home (no electricity, gas odor) should be directed to PSE&G at 1-800-436-7734

11. What do I do if a street light is out on my street?

You can either contact us at Public Works and we will fax the information to PSE&G, or you can contact them directly at 1-800-436-7734. Please give us the street address where the defective street light is located and the pole number (located on a metal tag on the street side of the pole).
Requests for additional street lighting should be directed to the Township Engineer.

12. What do I do if there is water running in the street?

If you see water running on the street or by a fire hydrant you may contact us and we will send someone to assess the situation. We will notify the appropriate agency for repair.

13. What if the catch basin at the curb line has debris or is in need of repair?

If you see debris in the catch basin causing water not to drain please contact us and we will have some one come out and clear it. If the catch basin is damaged, contact us and we will repair it. If the basin is on a State or County road, we will make the appropriate referral for cleaning or repairs.

14. What do I do if a street sign is down or has graffiti on it?

Please contact us if a street sign is damaged or down (parking restrictions, street name, directional signs) we will send someone from our traffic division to repair or replace it. If the sign belongs to the County or State, we will contact them.

15. Who can help me if I have issues or concerns with a neighboring home owner?

Issues and concerns with private properties (lawn maintenance, tree maintenance, home repairs) should be directed to Property Maintenance. The Property Maintenance inspectors can be reached at the Zoning Department. 973-325-4119

16. What do I do if my property was damaged by a town owned vehicle?

Any property damaged caused by the Public Works should be directed to the Business Administrator's Office to file an insurance claim.

17. The town removed a dead town tree from in front of my home, how do I get a replacement tree?

You can contact our Town Forester at (973) 325-4015 or contact us at Public Works and you will be put on a list for tree planting. For more information on when or what kind of tree please contact the Town Forester.

18. What do I do if there is broken glass or paint on the street ?

If there is broken glass on the street due to car accident or dropped recycables contact us and we will send a sweeper out to take care of it.
If paint is spilled on the road contact us and our traffic department will do their best to cover the paint on the street. Latex paint should be mixed with sand prior to disposal to prevent spills.

19. My street needs to be repaved, who do I contact?

For street resurfacing or paving questions please contact the Engineering Department at (973)325-4160. If your street scheduled to be repaved and you have questions regarding any aspects of the job, you may also contact the Engineering Department.

1. What is a revaluation?

A revaluation is a program undertaken by a municipality to appraise all real estate according to its’ fair market value. Revaluation brings all properties to 100%, thus insuring all property owners pay their fair share of taxes based on the fair market value of the property that they own. Fair market value is the price at which a property would sell for between a willing buyer and a willing seller. 

2. When will the program begin and end?

The program began in August 2023 and all work will be completed by December, 2024 in order to use the new assessments for the 2025 Tax Year. Field inspections are expected to run from September 2023 through February, 2024.

3. What is expected of property owners?

Equitable assessments depend on the cooperation of the property owners. Interior inspections, especially, require that residents cooperate with the data collectors. The validity of a market value depends on the collection of accurate data. Property owners have a stake in the outcome of the revaluation program. Any assistance a taxpayer can provide will aid in the total data collection process. If there is information you believe should be considered in the valuation, please inform the data collector. We will make every effort to cause property owners the least possible inconvenience.

4. Will photographs be used?

Photographs of your property will be taken by the revaluation firm. They will take exterior photos only. Photos will be of the front and rear of the main structure and 1 photo of all accessory structures such as detached garages, inground pools, cabanas etc. The photos will be taken at the same time as the exterior measurements.

5. Will the field inspector be able to tell me the new assessment?

The data collectors are not responsible for developing the market value estimate. Their job is to collect pertinent information to be used later as a base to develop the property’s value.

6. What will the data collectors look for?

Data collectors will record such items as the type of interior wall construction, the number of bathrooms, type of heat, central air conditioning, size, and the percentage of finished attic and/or basement areas, in ground pools and number of fireplaces. The exterior inspection includes measurements of each structure, such as garages or other accessory buildings, determination of story height, roof structure, and type of foundation and exterior wall construction. The physical condition of the structure is noted to establish depreciation factors. All factors relative to market value are considered. Examples of what would not be noted would be interior decorations, fences, window air conditioners, gas grills, and lawn furniture.

7. What if I’m not at home?

If you’re not at home when the data collector visits your property, an exterior inspection will be completed and a notice will be left asking you to call for an interior inspection appointment. Appointments can be scheduled on weekdays, evenings, as well as Saturdays, if need be. If the representative is unable to inspect your home or if you refuse entry, the interior information will be estimated which may cause your home’s valuation to be at the highest level for your property type, so your cooperation will be greatly appreciated.

8. When will I be advised of the proposed assessment?

When every property in the Township of West Orange has been revalued, you will receive a letter. Letters will be mailed in the late fall of 2024. You will be given the opportunity to discuss your assessment and review your property description with a representative of the revaluation firm.

9. Will my assessment increase? What affect will the Revaluation have on my tax bill?

Individual values may increase or decrease depending on the market value at the time of the revaluation.

The Revaluation Process is revenue neutral. In other words, no additional taxes overall will be raised for the school, county, or municipality as a result of the completion of this process. The impact of the new assessments will not affect the property owner’s tax bill until the 2025 Tax Year.

10. What is the difference between reassessment and revaluation?

A revaluation and a reassessment are synonymous, A licensed revaluation company performs a revaluation and the municipal tax assessor performs a reassessment. The municipality may also elect to perform a hybrid reassessment in which a municipality would hire a licensed revaluation company to assist the tax assessor with certain aspects of the reassessment. The outcome of any of these programs is the same; all properties are assessed at 100% of market value

11. Why does my Municipality need a revaluation?

Revaluations are required by New Jersey State Law and are generally ordered by The County Tax Board. Usually, once a Municipality’s ratio falls below an accepted percentage (or ratio) than the need for a revaluation arises. 

12. What is a ratio?

A ratio is the relationship between an assessment and sale price. Example: a property on one side of town is currently assessed for $60,000 and that same property sells for $100,000, the ratio would be 60%. A property on the other side of town is currently assessed for $50,000 and it sells for $100,000, the ratio would be 50%. After a revaluation, both properties should be assessed for $100,000 (100% of market value) and essentially paying the same amount in real estate taxes. 

13. Is a revaluation done to raise taxes?

NO. A revaluation will result in an increase in the assessed value, but it does not mean that all property taxes will increase. Assessments (or ratables) are a base utilized to apportion the budget (or tax burden). The budget is the amount your Municipality must raise for the operation of County, Local Government and support of the school system. The ratable base is multiplied by a tax rate to equal the budget. EXAMPLE: Prior to Revaluation:Total of all assessments (ratable base): $3 Billion Amount to be raised by Taxation (budget): $150 mil. Tax rate (per $100 of assessed value): $5.00 After Revaluation: Total of all assessments (ratable base): $6 Billion Amount to be raised by Taxation (budget): $150 mil. Tax rate (per $100 of assessed value): $2.50 **When the assessments go up, in contrast the tax rate will drop. If budgets increase than taxes increase.

14. How is a revaluation accomplished?

There are several steps in the revaluation process: Property Owner Notification- PPA will mail each property owner a letter approved by the governing body and municipal tax assessor to notify of the revaluation. Data Collection- a field representative from PPA will visit your property to collect the data necessary to eventually determine the assessment of your property. The representative will have a photo I.D. visible, which is on file with the Police Department along with his vehicle. An interior and exterior inspection are necessary to accurately assess the property. If a property owner is not home at the time of inspection, the field representative will leave a card on the front door and then measure the exterior to determine the square footage of living space, decks, pools, outbuildings, etc. The field representative estimates the interior data until an interior inspection is performed. The property owner will have the opportunity to call PPA (instructions and phone number on the card) and set up an appointment for an interior \inspection at a convenient time for the property owner. Again, to accurately assess the property, an interior inspection should be performed to ensure that all data is correct. Once we complete a section of town, we visit the homes we haven’t inspected once more and leave another card. If a property owner refuses entry to one of the appraisers, which is their right, the property can be assessed at the highest possible value. If appealed to the County, The County Tax Board will require full inspection before hearing the Case. The interior inspection generally takes about five minutes and the exterior inspection takes about ten minutes. After the interior inspection is performed, the field representative will ask the property owner to sign the property record card to verify that we did inspect the property. Analysis- while data collection is in progress, other staff appraisers are setting up the Municipality into sections based on local zoning and neighborhood characteristics. All properties’ lot sizes are obtained from studying the Tax Map. Sales that have occurred over the prior two years are analyzed to determine both residential and commercial values. The representatives in the field will ask questions about the sales to help determine if a sale would be applicable in later analysis. Commercial property owners will receive an Income and Expense statement to be completed and returned to help determine an Income Approach to value. This approach only applies to commercial property. All data collected, sales information, and market trends are utilized in determining the individual property values. Value Notification- prior to the assessments becoming the actual ratable base and public records for the Municipality, PPA will mail the proposed values to individual property owners. This notification is for the assessed value to go on the books for the upcoming tax year. This letter will not and cannot determine what your taxes will be for the upcoming year. The new tax rate will not be determined until approximately June of the tax year, which will based on the new ratables and the new budget. Informal Hearing- In the Value Notification letter, PPA will instruct property owners on how to set up an informal hearing with one of our appraisers. If a property owner is planning to attend an informal hearing, they should be prepared to bring in any documentation to support their disagreement regarding the appraised value of his or her property. For example, recent sales of similar or comparable properties could be an indication of value, and could be discussed. Recent appraisals for lending purposes would not be useful in an informal review due to the fact that they were completed for a different purpose. If any adjustment is necessary after an informal hearing, then a revised value will be sent to the property owner. The revaluation figures are adopted for the tax year after all processes are completed and the new tax bills will be mailed in Spring or early Summer and are retroactive to January 1st. The appeal date is the same as any other year, April 1st

1. Is anyone exempt from paying property taxes?

Yes, most hospitals, schools and government properties are exempt from property taxes. Permanently and totally disabled veterans of war are also exempt from payment of property taxes. In addition, many religious and non-profit organizations qualify for property tax exemption.

2. When will I receive my assessment postcard and tax information?

Postcards are mailed to property owners the end of January. This statutory requirement is intended to inform property owners of their assessment for the current tax year.

A taxpayer does not file an appeal of his/her taxes but rather the assessment. West Orange Township taxpayers who believe that their assessments are not fair as of October 1st, of the pretax year (the assessing date) have the right to file an appeal with the Essex County Board of Taxation on or before April 1st of the tax year.
